Terms of service

Template. These terms are a plain-English starting point written for Aryaga. Have a solicitor review them before taking payment from customers.

What Aryaga is

Aryaga provides online photo galleries created in memory of a person, reached through a web link or QR code (usually printed in an order of service). The family's photos are shown, and guests may share their own photos with the gallery.

How long a gallery stays online

Each gallery stays online for 12 months from the date it is created, unless a longer period has been agreed. When that period ends the gallery goes offline, and the gallery and its photos are permanently deleted within 30 days. Please keep your own copies of any photos you want to keep — a gallery is a way of sharing photos, not a photo backup service.

Before a gallery expires, it can be extended for a further period (1 month, 6 months or 1 year) for the fee shown on the gallery page. The extra time is added once payment is confirmed.

Sharing photos

By uploading a photo you confirm that you took it or otherwise have the right to share it, and that it is appropriate for a memorial page. Photos must not be unlawful, offensive or hurtful to the family. The family (or the person managing the gallery) decides which shared photos appear, and any photo can be removed at any time. We may also remove content or close a gallery that breaks these terms.

If a photo of you appears and you want it removed

Email hello@aryaga.co.uk with a link to the gallery and which photo you mean, and we will deal with it promptly.

Payments

Payments are taken securely by our payment provider (Stripe). Extension fees are for keeping a gallery online for the chosen period and are non-refundable once the period has started, except where the law says otherwise.

Our responsibility

We look after the service carefully, but we can't promise it will be available without interruption, and we aren't responsible for photos lost after a gallery has expired and been deleted in line with these terms. Our total liability to you is limited to the amount you have paid us for the gallery concerned. Nothing in these terms limits liability that can't be limited by law.
